1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Autos by Hart LLC website and your purchase of vehicles from us. By using this website or submitting a purchase inquiry, you agree to these Terms.

2. Vehicle Listings

We make every effort to ensure listings are accurate, including photos, mileage, specifications, and pricing. Listings are provided in good faith; minor variations may exist. All vehicles are sold as described in the listing and confirmed in the Purchase Agreement. Prices are subject to change until a Purchase Agreement is signed.

3. Purchase Process

Purchases follow the process described on our How to Buy page:

• A vehicle is reserved upon receipt of full payment, made securely using the payment details provided by our financial department.
• Your payment is held in trust by our financial department for a 10-business-day inspection period after delivery.
• Delivery: FREE to the majority of states until August 12 (limited-time promotion); otherwise a flat rate of $0.30 per mile to your specified location.
• The sale is finalized when you sign the bill of sale and title transfer documents.

4. Inspection Period & Returns

You have 10 business days after delivery to inspect the vehicle. If it does not meet your expectations, you may return it at no cost to you — we cover return shipping and issue a full refund within 24 hours of the vehicle's return. Vehicles must be returned in the condition they were delivered, excluding reasonable test-drive mileage.

5. Warranty

Every vehicle we sell is backed by a 6-month warranty as described in the listing and Purchase Agreement. The warranty does not cover damage caused by misuse, neglect, accidents, or unauthorized modifications after delivery.

6. Payments

Payment details are provided by our financial department only after a signed Purchase Agreement, along with your invoice. We will never ask you to pay via gift cards, cryptocurrency, or peer-to-peer payment apps.

7. Title & Registration

We provide a clear title with every vehicle sold unless expressly stated otherwise in the listing. Buyers are responsible for registration, applicable taxes, and licensing fees in their own state.

8. Limitation of Liability

To the maximum extent permitted by law, Autos by Hart LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or the purchase of a vehicle, beyond the purchase price paid.

9. Website Use

You agree not to misuse this website, attempt unauthorized access, or submit false information through our forms. Content on this site (text, images, branding) belongs to us or our licensors and may not be reproduced without permission.

10. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Lewis and Clark County, Montana.
